Collection agencies are always using credit card garnish tactics to scare you into making payments. Are they legally able to do this, Is there any way that you can stop creditors from using these stronghold tactics, The answer is yes and no. It all depends on the laws within your state. There are federal laws which regulate and monitor garnishment practices, but it ultimately depends on the laws of your individual state. Check your state laws and determine if your wages can be garnished by credit card companies. State Laws Not all states allow credit card garnish laws. The states that do allow wage garnishments want to make sure that you have money left over for living expenses. Many would say that this living amount is not adequate, but it guarantees that the creditor's right to payment will not be ignored. However, if your state laws do not support wage garnishments, you are still responsible for making all child support or school loan payments that are due. Also understand that there is a process for how your wages should be set up for garnishment. Although creditors are allowed to make credit card garnish arrangements within certain states, they cannot do so until they contact you, take you to court, win the case and the judge decides how he wants your wages to be garnished. In order for the process to be legal, all of these steps have to be present within the garnishment process. If you discover that your wages have been garnished without your knowledge, you have legal grounds to have it stopped. Chances are your creditor did something illegal. Warnings Although there are dishonest collection agencies that will go after your wages, there are also the ones that are legitimately due payment. You know when you have debts that have been left unpaid. Try to make arrangements with your creditors to get your debts paid. They are usually willing to work out some type of payment arrangement. However, do not be surprised when your creditors attempt to make credit card garnish arrangements with your employers. When you are informed and summoned to court, do not ignore the notices from your credit card company. Ignoring your debt or your creditors will not make the situation go away. If you fail to show in court to address the charges, your creditor will win by receiving a default judgment. Unfortunately, you will be ordered to pay everything that is owed to your creditors. Don't let this happen to you by default. Credit cards make it easy for you to enjoy many luxuries now with your promise to pay for those luxuries at a later date. Although this is your original intent, sometimes this is not how the situation plays out in the end. Many times those same luxuries have long since gone, but you are still paying for them. Sadly enough, your creditors come after you when you no longer are able to make payments. Unfortunately, many times wage garnishments are unavoidable. If you find yourself within this situation, research the laws within your state and determine if your creditors are within their rights to initiate credit card garnish arrangements with your employers.
